Terry Colley: Fighting for Freedom
Could you imagine being on trial and never being told of a plea deal? Your appointed legal council fails to acknowledge your existence at all and at the end of the day, you are railroaded by the system? Terry Colley has spent 21 years out of a 60 year sentence in USP Atlanta. . What’s even harder to understand is that Colley’s rights as a prisoner were violated: From September 21, 1994 to November 21, 1994; A plea deal by the government was made on Colley’s behalf in which Colley was never informed. In fact, Colley’s legal council rejected the plea deal without even informing Colley that negotiations were taking place. The crazy part is, this isn’t all that happened. It actually got worse.
What is interesting in this case is that, There are no records of any court documents of witness testimony. There were no reported fatalities, injuries, or restraints. Terry Colley is in Prison for what is known as an “Old School” bank robbery. There was no real gun used in his offense. Is 60 years really a just sentence for someone who veered down the wrong path after surviving a troubled childhood? Terry Colley will be 85 years old by the time his sentence is completely served. It leaves one to question: Is this a just punishment for this crime and can the system really railroad a man like this and get away with it? Is 21 years not enough? The argument of Terry’s innocence is not the issue. Colley acknowledges his role in the crime. The argument simply surrounds the word: Justice.
“You see, you can’t do a long term prison sentence with hate or vengeance in your heart, mind or soul. It will make you deteriorate fast! Seriously, you will lose hair, teeth, brain cells get weak because you only using the ones that make you hate something, your skin gets bad and you become a management problem. Most likely addicted to some form of legal drug being sold in prison too. So one day, you gotta sit down and forgive yourself, those who have betrayed you, those you hate, the ones who hurt you or somebody you love, and you gotta purify……. gotta pray for them this one time and release their energy outta you! When you do that, that’s the day you become a different person that is happier with life….. can see the real enemy and your purpose clearer”

Terry Colley is in the battle of his life. He is the last of three men that is still held captive in a crime that was deemed to not have a “leadership” role, even though he was the oldest (23). What makes this even worse is that Colley’s co-defendants both only served a decade for this crime while the book was thrown at Colley. The other defendants have also been out for a decade and have reinserted themselves into society. I’m sorry but something just doesn’t add up here. We MUST reexamine the case of The United States vs. Colley again. Is 60 Years, really fair? Better yet, is 60 years without notifying the one on trail of a plea agreement even constitutional? Colley never got to “Plea on the Nose” neither. That also supports the fact that he was never informed about the plea. The question isn’t whether or not if Terry Colley was involved in the crimes that he was convicted of, the question lies in the conviction and the trial process for Terry Colley (which was so fast, it was nearly a blur).
After a trouble adolescence and an unhealthy battle with depression rooting back to his childhood, It is safe to say that Terry has reformed his life today while being behind the wall. He has used these 21 years as a time of reflection. He did not allow bitterness or even that familiar spirit of depression to consume him. Instead, Terry Colley used his prison experience positively and as the tool to jump-start the process of him rehabilitating his life. He has become the peacemaker. All he needs is a chance. Is that too much to ask?
“I have pretty much exhausted all forms of legal relief pertaining to my federal case where the courts have continued refusing to address the legal issues surrounding my 1994 guilty plea proceedings that I contend violated my due process rights, and right to effective assistance of counsel under the 5th and sixth amendments to the U.S Constitution. No evidence has ever been found that I personally rejected a plea offer or that I was ever informed that a plea offer even existed for a 17 year sentence that a court appointed attorney turned down without my involvement, knowledge, or consent. I am optimistic that one day I will be able to prevail with the right professional legal assistance that can show that I was not in federal custody during the federal plea process, in which I was required to be, in which, my case is now one, where the rules were changed and have been swept under the rug for over two decades.”

I consider it to be a redundant self infliction for us to still be dependent on a strategically merciless system for “justice.” We as society members as a collective are responsible for participating in the election of judges having so much authority. We already know we are in a rigged paradigm where the life of someone as Terry Colley is of least value. Now the tragedy is not the fact that we keep letting this type of injustice go, but collectively we as society keeps watching like its all a movie about modern day lynching through the justice system. We as citizens need to learn how to vote, make our vote counts and learn how to govern our justice system!
Freedom has its life meaning and substance. The spirit of a man when it comes to freedom, must be eventually earned and refreshed or else his livelihood is no greater than a flower cut from its life sustaining roots, it will wither and die. Free Terry Colley!!!!
I have seen so many violent crimes being committed on children and the elderly and they got less time than Terry, who was just a troubled child and needed help but to sentence him to spend the rest of his life in prison
is not justice in this case. Justice should be about rehabilitation and building him up to be a better man and free him. Im looking for justice for Terry Colley because he has done more than this time

Wow! what a terrifying story. Can you imagine yourself being in such a helpless situation that could easily be corrected if the legal system of the United States of America was fair and just. How do we get this racist country to turn its heals and actually serve the Constitution that it claims to stand on?

Terry Colley deserves a second chance. I am sending my comment of support for some type of official address into his case because he has been in the system since he was age 23. He should be given a second chance!

The entire United Snakes Injustice system is full of corruption. Having a court-appointed lawyer is like have the D.A as your defense attorney. That’s how a lot of people get railroaded because they do not have the money to pay for a proper defense lawyer. The D.A and the judge job security depends on how harsh they deal with criminals. That court-appointed attorney was probably paid or promised a favor for not showing that brother the plea deal.

I’m writing in support of Terry Colley, an inmate at Atlanta Fed Penn. I realize that when a crime is committed there is a penalty. And I would say to you today that Terry Colley has pad that penalty. He’s paid the penalty with over 20 years of his life. He’s been sentenced 60 years. A decision was made on his behalf without his knowledge…a pleas bargain was never offered or explained to him, he was never advised about the plea bargain—these decisions of the legal system resulted in him being sentenced to 60 years.
Think about the enormity of this injustice….60 years without chance of parole. I am personally utilizing every outlet available to raise awareness of Terry’s fight for freedom. I am appealing to Terry’s family, friends, advocates in the civil rights community, and everyone. Even if you don’t know Terry—that’s alright. Just know that he is fighting for his life…that he’s been incarcerated over 20 years, without any hope of parole, after being denied and advised of his plea bargain rights! he needs your support—positivity, spiritually, financially and righteously.

It’s an outrage that you were basically sentenced to life behind bars. It is a disgrace to our legal system that you were denied your rights. It should not have been left up to your legal advisor whether or not you take a deal. It seems unjust that this could go on and nothing be done about it. We all make mistakes and yes I believe in paying for your crimes but this sentence does not fit the crime. Murders and rapist do not get the time that was handed down for you. The law and practices need to change. My prayers are with you.
After reading your article I can’t seem to get your situation off my mind. I hate the injustice that was placed on you. 60 years is a very long time for a non violent crime. Its complete nonsense to me. The laws have to be changed. My heart is hurting for you cousin — with Jerome Being Maverick.

WOW! i have NEVER heard a story such as this in my entire life!! first of all I’m gonna tell ya…the reason you are still serving time is because I believe your acomplices might have snitched you out!! and you being the oldest of them all they gave you the hardest sentence or in other words somebody has to take the blame! it’s crazy!! and you mean to tell me that you all didn’t even use real weapons to assist you in the robbery atempt??!! Well all I can say is try in hired a high prophile lawyer (if you can) to get you out of this situation, and sweetheart this is your time to DRAW CLOSE TO GOD..i mean you need to walk with him all the days of your life from here on out, cause it seems to me God wants something from you permanently! I feel it is an injustice that you did not hear of the plea and was not able to make that decision, instead of spending the rest of your life behind bars, the person that represented you should live in guilt for the rest of their life for not handling your case to the best of their ability and if they couldn’t, they should have let you know that and excused themselves. God has bigger plans for you because we are bigger than our issues. I pray that the plight of your injustice fall on the right ears and that something happens soon. Stay prayed up.
